Seller Terms and Conditions
As registered Sellers, you’re required to accept Platform policies while listing items for sale. You must be legally entitled to sell, also having all appropriate licenses or permits. Listings must not infringe upon anyone’s intellectual property, trade secret, proprietary rights of publicity or privacy. Text descriptions, pictures, graphics or videos should be included in listings to illustrate the products for sale. Listed items should then be categorized correctly for fulfilment of sales. Further, the condition of the item or quality must not be misrepresented in the list description. In the case of disparity between the item description and actual condition of the product, any amount received from the Buyer must be refunded. Multiple listings of single product over various categories is strictly forbidden; listings of this kind will be deleted by Pashmina Cart. Additionally, Pashmina Cart may also restrict selling of goods from certain countries.
Pashmina Cart is merely a facilitator and does not interfere in the transaction between Buyers and Sellers.
The sale of pashmina products (“Products”) within the Pashmina Marketplace (“Marketplace”) shall be the responsibility of Sellers. The Seller is the party that accepts the order from a customer, processes the order, and sets the final price of the products. The products shall be 100% pure pashmina handmade by Kashmiri Artisans only. Any discrepancy, shall be compensated or any consequences arising thereof shall be borne by the particular seller itself.
The Seller is solely responsible for the delivery of the products to customers and is solely responsible for the quality and accuracy of all products listed on the Marketplace. The Seller is responsible for all applicable taxes, fees and commissions associated with sales on the Marketplace.
The Seller’s use of the Marketplace will include the use of an online platform to issue orders, track orders and communicate with customers. The Seller agrees to use this platform in a professional and responsible manner.
The Seller agrees to use the online platform in compliance with these terms and all applicable laws, regulations and rules.
The Seller is responsible for all income taxes, fees and other taxes or fees of any kind related to sales on the Marketplace.
The Seller is exclusively responsible for the listings of its products on the Marketplace and for any claims related to the description, accuracy, currency, advertising and pricing of the products. The Seller shall use best efforts to ensure the accuracy of the product descriptions and shall comply with the Marketplace’s listing and pricing policies.
The Seller agrees to provide customers with a full refund, if any product purchased is found to be defective or does not meet the customer’s expectations. The Seller agrees to provide customers with an exchange of any product purchased which is not satisfactory, with the same product of similar value.
The Seller shall ensure that GST/VAT and other applicable taxes, fees and charges of any kind are accurately collected and remitted to the applicable authorities.
The Seller shall comply with all applicable laws, regulations and rules with respect to its use of the Marketplace, including those related to antitrust and consumer protection.
The Seller represents, warrants and covenants that it has the right and authority to enter into this agreement and to perform its obligations hereunder. The Seller shall not, directly or indirectly, violate any laws or regulations applicable to its use of the Marketplace and shall not use the Marketplace for any purpose which is fraudulent, misleading, or illegal.

Vendors/Sellers hereby agrees to indemnify, defend, and hold harmless Pashmina Cart, its officers, directors, managers, members, employees, representatives and agents from any claims, demands, damages, costs, liabilities and expenses (including, but not limited to, attorney’s fees) arising out of or relating to Vendor’s performance or breach of this Agreement.

Any discrepancy/adulteration in the authenticity of an item/product, the seller would be banned from platform and also reported to the concerned Handicrafts department of Jammu and Kashmir for necessary action and shall be liable to pay compensation/fines to the customer/department.

Sellers must respond to customer inquiries within 24 hours and provide excellent customer support.

No seller should ask, suggest or advise any user/buyer/customer to purchase the products listed on the website, in offline capacity. The transaction shall only take place via Pashmina Cart. Otherwise the buyer protection gets forfeited in case of any discrepancy or issue related to order.
