The purpose of this document is to provide buyers with clear protection instructions when making purchases through the Pashmina Cart, and to define the rights and obligations of both sellers and buyers.
We strictly suggest not to make any payment outside of this platform. The basis of protection is the Pashminacart.com’s online order. It is only enforced when you pay online via Pashminacart.com.
In particular, this document outlines the rights and obligations of both sellers and buyers concerning frauds, quality, scams, phishing, data theft, refunds/exchanges, warranties, authenticity claim, and in-genuine product.
Seller Frauds
Seller frauds involve the sale of counterfeit or stolen goods and the misrepresentation of products or services. All sellers must state clearly on the product and service page all facts regarding the product or service being offered, such as the brand, manufacturer, size, color and other necessary information related to the product or service.
The Pashmina Cart mandates that all sellers provide accurate and truthful information about their products and services to buyers and that sellers must honor both their written warranties and any promises they make orally.
Any attempt to defraud buyers through misrepresentation or false or misleading advertising will not be tolerated and any violations of these rules can result in immediate suspension or expulsion of the seller with legal consequences.
Quality Fraud
Quality fraud involves the sale of goods or services that have been found to be either Fake, blended Pashmina, unreliable, of inferior quality, or even defective. The Pashmina Cart will not tolerate any quality fraud from members and all sellers must provide full disclosure relating to the quality of the product.
Sellers must acknowledge in writing, any possible defects or issues prior to the offer for sale of their product, and the buyer must acknowledge that he/she is aware of any potential quality issues. Sellers must also ensure that all of their products are fit for purpose and in line with payment terms.
Scams
Scams involve the use of deceptive practices by sellers to deceive buyers into giving them their money or personal information. The Pashmina Cart has a zero-tolerance policy to scams and all sellers must provide clear and honest information when communicating with buyers. All payments should be made directly to a reliable third-party payment processor, such as PayPal or Razorpay, UPI or other payment gateways through Pashmina Cart only.
If a buyer becomes suspicious of a seller’s practices, or has any doubts that the seller is not legitimate, they should cease all contact immediately and contact the Pashmina Cart for assistance in evaluating the situation.
Phishing
Phishing describes fraudulent attempts to obtain sensitive information, such as credit card numbers, social security numbers and login credentials through emails or fake websites. All sellers must ensure their communications are accurate and their intentions are honest. Any emails or webpages that appear to be phishing attempts must be reported to the Pashmina Cart immediately.
Data Theft
Data theft is the unauthorized use or access of a person’s personal information, such as bank account numbers or passwords. All sellers must adhere to the highest security standards when handling personal data, and must ensure that all data is encrypted and stored securely.
The Pashmina Cart reserves the right to investigate all data theft claims, and will take appropriate action against sellers found to be in violation. This can include the suspension or expulsion of the seller from the Pashmina Cart with legal consequences.
Refunds/Exchanges
A seller’s refund must adhere to their stated return policy, which must be detailed clearly on their product pages or invoices. All sellers must issue a full refund or exchange items within a reasonable amount of time, and must provide a valid reason for the exchange or refund being made.
The Pashmina Cart handles refunds or exchanges on behalf of the seller, and will investigate all claims of a seller not issuing a refund or exchange when it is due. If the seller is found to be in breach of the return policy, the seller might be delisted.
Warranties
All sellers must offer a warranty for their products and services. A seller’s warranty must be detailed clearly on their product pages, invoices, and all other documentation sent to the buyer, detailing clearly all of the conditions and obligations of the warranty.
The Pashmina Cart handles all claims for breach of warranties and will investigate any complaints from buyers.
Authenticity Claim
Each seller must include an authenticity claim when listing their products and services. This authenticity claim should state that the product or service has been verified by an independent third-party, or that the product meets a specific quality standard. Every product would be inspected and checked as per the guidelines of Directorate of Handicrafts Kashmir.
The Pashmina Cart reserves the right to investigate any authenticity claims, and will take appropriate action against sellers found to be in breach of their obligations. This can include but is not limited to immediate suspension or expulsion of the seller from the Pashmina Cart with legal consequences and reporting to the Pashmina Quality Control department.
Disclaimer
The Pashmina Cart makes no warranties or representations regarding the accuracy or completeness of any information provided by our sellers, including all related warranties of merchantability, fitness for a particular purpose, legality, or non-infringement.
The Pashmina Cart disclaims any liability for any damages or injury caused as a result of any sales or purchases made through its platform.
Indemnification
The Pashmina Cart requires all sellers to indemnify and hold the Pashmina Cart, its officers, employees, and agents harmless from any and all claims, liabilities, losses, expenses, and costs resulting from any claim or action asserted by any buyer of their product or service.
Compensation
The Pashmina Cart requires all sellers to provide compensation to any buyer who experiences a loss, damage related to their purchase, if caused due to seller negligence or false claim, sellers in-genuine product, fake products, or any quality related damage.
The Pashmina Cart reserves the right to determine the degree of compensation, based on the type and seriousness of the loss, damage, or injury.
In-genuine Product
The Pashmina Cart requires all sellers to ensure that their products and services are legitimate, genuine and in line with the terms of sale. The seller agrees to fully cooperate with the Pashmina Cart during any investigation and to provide proof of the authenticity of their products and services.
In the event that the Pashmina Cart finds a product or service to be ingenuine, the seller shall refund and will be reported to Pashmina Quality Control department of Kashmir.
Conclusion
The Pashmina Cart will not tolerate any fraudulent or deceptive practices by sellers, or any attempt to harm our buyers in any way. All buyers should be aware of their rights when purchasing from our platform, and any violation of these rights will not be tolerated.
The Pashmina Cart has a zero-tolerance policy for fraud, quality issues, scams, phishing, data theft, refunds, exchanges, warranties, authenticity claims, and in-genuine products. Any seller found in violation of these policies will be subject to immediate suspension or expulsion from the Pashmina Cart, and will be reported to Pashmina Quality Control department of Kashmir.
